Summary

We are seeking Litigation Attorneys to join our team at Glassman, Wyatt, Tuttle & Cox, P.C. This position will be based in our office and will play a vital role in representing clients in complex civil litigation cases. The ideal candidate will contribute to our mission of providing exceptional legal services and achieving favorable outcomes for our clients.

Position 1: Civil Litigation Attorney - Responsibilities

  • Represent clients in court during trials and hearings.
  • Conduct thorough legal research and prepare legal documents.
  • Develop case strategies and provide sound legal advice to clients.
  • Negotiate settlements on behalf of clients when appropriate.
  • Collaborate with other attorneys and staff to ensure effective case management.
  • Stay updated on relevant laws and regulations affecting cases.
  • Prepare witnesses for trial and conduct depositions as necessary.
  • Maintain accurate records of case progress and client communications.
  • Draft motions and pleadings
  • Prepare for and take depositions
  • Attend site inspections
  • Perform medical record review and analysis
  • Assist with discovery process including written discovery, document production

Position 2 - Workers Compensation Attorney - Responsibilities

  • Evaluate claims files and case materials from employers and insurance carriers to assess compensability and causation issues, in addition to evaluating other statutory defenses.
  • Prepare mandatory jurisdictional and claims Forms required for filing with the Tennessee Bureau of Workers' Compensation.
  • Communicate and provide legal opinions and recommendations to employers and insurance carriers as to proper claims handling.
  • Review and analyze medical records and medical reports from medical providers to determine necessity of medical treatment and primary relation of treatment to compensable work injuries.
  • Evaluate claims in order to make recommendations to employers and carriers regarding exposure for indemnity and medical benefits, with an eye toward mitigation of exposure.
  • Make recommendations to employers and carriers regarding settlement negotiations and authority necessary for expedient settlement and resolution of claims.
  • Prepare Motions, Discovery Pleadings, Trial Briefs, and other Forms/Pleadings required for filing with Tennessee Court of Workers' Compensation Claims, including appellate pleadings for filing with the Tennessee Workers' Compensation Appeals Board and Tennessee Supreme Court.
  • Prepare mandatory settlement documents and forms required by the Tennessee Bureau of Workers' Compensation and Tennessee Court of Workers' Compensation Claims for the settlement of a claim and the approval of same by the Court.
  • Attend Court Hearings (both in-person and virtually) related to administrative proceedings, Motion Hearings, Trials, and Settlement Approvals.
  • Foster a close working relationship with partners/lead attorneys handling cases in order to ensure effective and efficient representation of clients while providing zealous advocacy on clients' behalf.

Qualifications

  • Juris Doctor (JD) degree from an accredited law school.
  • Active license to practice law in the relevant states.
  • Strong background in civil litigation with proven trial experience.
  • Excellent legal research skills using tools such as Westlaw.
  • Ability to analyze complex legal issues and develop effective strategies.
  • Strong communication skills for client interaction and courtroom presentations.
  • Detail-oriented with strong organizational skills for managing multiple cases.
