Job Description
The Business and Trademark Counsel will provide strategic legal guidance on business transactions, branding, and trademark matters. This role requires a thorough understanding of trademark law, intellectual property management, and business law, with a focus on risk mitigation and regulatory compliance to support the company's growth objectives. The ideal candidate will work closely with various departments to protect and enforce the company's brand assets and provide general business counsel.
Key Responsibilities:
Trademark Management: Handle all aspects of trademark registration, maintenance, and enforcement. Conduct trademark searches, analyze potential risks, and manage global trademark portfolios.
Brand Protection: Develop and implement brand protection strategies, including monitoring, dispute resolution, and enforcement actions (e.g., cease-and-desist letters).
Business Transactions: Review, draft, and negotiate a variety of commercial agreements, including licensing, non-disclosure, vendor, and partnership agreements.
Legal Compliance: Ensure compliance with IP laws, regulatory requirements, and industry standards, including risk assessment and implementation of best practices.
Intellectual Property Strategy: Advise on IP-related business strategies, including product development, branding initiatives, and mergers/acquisitions.
Policy Development: Develop and implement internal policies related to IP protection, usage, and licensing.
Cross-functional Collaboration: Work closely with Marketing, R&D, and Product teams to align on brand strategy and intellectual property protections.
Litigation Management: Oversee and coordinate with external counsel on IP litigation, enforcement actions, and disputes.
Qualifications:
~ Juris Doctor (JD) from an accredited law school.
~ Licensed to practice law in Colorado.
~5+ years of experience in trademark and intellectual property law, with a focus on brand management and business transactions.
~ Strong understanding of U.S. and international trademark law and regulations.
~ Demonstrated experience in contract negotiation, drafting, and risk management.
~ Exceptional analytical, organizational, and communication skills.
~ Ability to work independently and collaboratively in a fast-paced environment.
Preferred Skills:
Experience with litigation and dispute resolution.
Familiarity with IP portfolio management software.
